In the news today, the owner/founder of H&H Bagels was arrested on tax charges, and at B&H Photo, a world famous Camera/Video store three female former employees are suing for 7 million dollars for violating the EEOC for refusing to place women on the sales floor, citing “religious” reasons - The owners are Chasidim, and used their cultural belief to deny women the right to earn a higher wage.
From The Village Voice:
B&H Photo Video, the famously well-stocked, reasonably-priced, and knowledgeable-staffed midtown store, employs a large number of orthodox Jews on the floor and in management, but plaintiffs in a lawsuit say they’re not so good about hiring and promoting women. Naskinsha Cushnie and three other female job-seekers claim discrimination. Cushnie says she was told she couldn’t move from cashier to sales clerk because Jewish law forbids it…
The ladies’ lawyer, Richard Ancowitz, cites not only civil but religious law: “I have consulted with leading authorities, and it is quite clear that there are no tenets of Jewish law that require the sales force to be male-only.”
B&H strongly denies the charges (”B&H has a policy of not discriminating against employees and applicants”).
From The New York Post :
…Ancowitz said that under the law, B&H has no First Amendment-religious freedom to discriminate against women. He also said that they also have no right under the Torah to discriminate.
“I have consulted with leading authorities, and it is quite clear that there are no tenets of Jewish law that require the sales force to be male-only,” Ancowitz said. “In fact, the Torah itself teaches, ‘Justice, justice, you shall seek.’ “
on one site, Yeshiva World, all are whinging about the B&H suit, saying they are being persecuted because of their “beliefs”: They claim it violates Orthodox/Chasidic rules of modesty for women to work next to men if not related. . I call bullshit. If my money is good enough for you to take, I should be good enough to work for you on the sales floor. Let me give you a clue by four: B&H is a business that employs non-Jews. Including Muslims. Therein lies my anger.
From the B&H “Professional Careers page”:
Is B&H an equal opportunity employer? Yes. B&H is committed to hiring and promoting without regard to religion, race, sex, national origin or ethnicity, age, disability, sexual orientation, and/or any other protected status.
BUT!!!! farther up that same FAQ:
What happens after I submit my application? Our staff of recruiters carefully reviews all applications and forwards qualified candidates to the proper hiring manager. Note: Due to the high volume of applications only qualified candidates will be contacted.
So, there is the application “out”: WE JUST COULDN’T FIND ANY QUALIFIED WOMEN TO WORK AS SALES REPS.
and, here’s the EEOC’s guidance on sex discrimination:
Home › Guidance: Sex Discrimination
Sex Discrimination
Title VII of the Civil Rights Act of 1964 protects individuals against employment discrimination on the basis of sex. Title VII applies to employers with 15 or more employees, including state and local governments. It also applies to employment agencies and to labor organizations, as well as to the federal government. It is unlawful to discriminate against any employee or applicant for employment because of his/her sex in regard to hiring, termination, promotion, compensation, job training, or any other term, condition, or privilege of employment. Title VII also prohibits employment decisions based on stereotypes and assumptions about abilities, traits, or the performance of individuals on the basis of sex. Title VII prohibits both intentional discrimination and neutral job policies that disproportionately exclude individuals on the basis of sex and that are not job related.
These “Jews”, along with the louts who own the largest Kosher slaughterhouse in the nation - who underpaid their workers, denied them basic benefits and dignity, have quite happily bought into the Christian stereotype of the Jew.
They have placed themselves above Torah & Talmud which requires us to treat all with respect. They are the wicked, not the pious.
