This follows the congress’s Power to define Piracy issue Letters of Marque and Reprisal and other items

To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;

Mr. Yoo is not correct when he asserts the Congress does not have the Power to Declare Ware, and that it is the President who does that. Tyrants do that. Not Americans.
