From the Introduction:

.This document is a code of best practices that helps creators, online providers, copyright holders, and others interested in the making of online video interpret the copyright doctrine of fair use. Fair use is the right to use copyrighted material without permission or payment under some circumstances.

This is a guide to current acceptable practices, drawing on the actual activities of creators, as discussed among other places in the study Recut, Reframe, Recycle: Quoting Copyrighted Material in User-Generated Video[1]and backed by the judgment of a national panel of experts. It also draws, by way of analogy, upon the professional judgment and experience of documentary filmmakers, whose own code of best practices has been recognized throughout the film and television businesses.

 
The document does not codify “Fair USe”

When you create a fanvid or mashup, to fall under Fair Use, the work must answer two (2) key questions:

* Did the unlicensed use “transform” the material taken from the copyrighted work by using it for a different purpose than that of the original, or did it just repeat the work for the same intent and value as the original?
* Was the material taken appropriate in kind and amount, considering the nature of the copyrighted work and of the use?
In the case of a fanvid, this can be tricky. how long a clip is Fair Use? I have videos that are acceptable for Youtube and some that are not I presume due to the length of the clips I used in order to get the point made. A prime example of Fair Use is the Make McCain Exicting Challenge over at The Colbert Report.

Ryan is asking for donations. Either a set amount or a per metre pledge 1¢ per metre = $56.42US.

A SHOPPING trip has ended in a record label stoush for touring American, Nine Inch Nails rock star Trent Reznor.

 

 

In Melbourne for three sold-out gigs that ended last night, Reznor was furious to find his band’s latest album selling for $10 more than other Top 40 CDs.

 

 

At his first tour stop in Brisbane, he demanded an explanation from a sales rep from his record label, Universal Music.

 

 

"He goes, ‘Oh, because your packaging is a lot more expensive’," Reznor said.

 

 

 

"I know how much the packaging costs — it costs 83c more to have a CD with the colour-changing ink on it.

 

 

"I’m taking the hit on that, not them. So I said, ‘It doesn’t cost $10 more’.

 

 

"He goes, ‘You’re right, it doesn’t. Basically it’s because we know you’ve got a core audience that’s gonna buy whatever we put out’.

 

 

"I said, ‘That’s the most insulting thing I’ve heard. I’ve garnered a core audience that you feel it’s OK to rip off?

 

 

Reznor made Universal staff buy their own concert tickets.

LOS ANGELES (Hollywood Reporter) - With uncertainty looming over its presence on YouTube, Comedy Central is refining its broadband video strategy.

The network is launching a revamped version of its online programming platform, MotherLoad, this month with a new syndicated video player at its heart, the network said Wednesday.

MotherLoad will be integrated deeper into Comedy-Central.com while offering a syndication capability allowing users to grab and embed their favorite clips for posting on their own Web pages. The new video player is part of a makeover of the channel’s Web site.

The site also will use a Flash video format and is designed to be more user-compatible on Macs and older PCs and for users with pop-up blockers.

With all the shit I have been through over the past few years, I have not simply survived it, I have overcome it. Sure, a couple of issues have yet to settle out, but I am intact Soul-wise. Spirit-wise. I have been through, quite literally Fire and Ice and am now tempered as though my Soul and Spirit are now Damascus Steel.

Unlike those undeserving sluggards, the abraham men and mad maudlins, who, with assistance, have learend to game the system, to take from those who truly need it… Those whose problems are petty when placed in the context of “Need”.

Back in 1983, I believe, I took part in a Ritual overseen by the Late HymenÆus Alpha. I was initiated in aThree Person Order. Three of us became Knight Companions to the Holy Graal. When it came my turn to state the Nature of My Quest, I replied

“To Replace Faith with Knowlege.”

I have made much progress since then. I think Niall Bon Couer and Louis would be proud of my progress. Niall is with me, in my heart. and recently appeared to me in Dream.

My ethics are intact. Despite being advised to abandon them in oh, so subtle ways. I have achieved success. It’s true what they say about making it in NYC:

“If you can make it there…” and it’s not just about making it in business. The phrase is more about Life. This place is CRUSHING. Perhaps, it is because the first thing I ever tasted was blood. quite literally, blood - the doctors nearly killed both my mother and me. or, because I came into the World wanting to show everyone my ass.

Update: I decided to take the entire entry to “My Eyes Only” after deciding that there is a bit too much info about and where I went to school, and other things. I don’t believe in placing things in the Memory Hole and pretending they never occurred.
